A judge on Friday ruled that Maricopa County must provide some 2.1 million ballots from the Nov. 3 election to the Arizona state Senate and allow access to its election equipment to conduct an audit.
Maricopa County Superior Court Judge Timothy Thomason ruled that subpoenas issued by Arizona’s state Senate are valid and should be enforced, and he disputed arguments from Maricopa County officials saying the subpoenas are unlawful. The county previously stated that multiple audits have been sufficient and said ballots should be sealed.
“The Court finds that the subpoenas are legal and enforceable,” Thomason wrote (pdf) in his ruling. “There is no question that the Senators have the power to issue legislative subpoenas. The subpoenas comply with the statutory requirements for legislative subpoenas. The Senate also has broad constitutional power to oversee elections.”
He argued that the “Arizona legislature clearly has the power to investigate and examine election reform matters,” adding that senators can “subpoena material as part of an inquiry into election reform measures.”
The move was hailed by Republican legislators in Arizona.
Arizona Senate President Karen Fann, a Republican, told news outlets after the judge’s ruling that their move was “never about overturning the election, it was about the integrity of the Arizona election system.”
“This was always about voter integrity and the integrity of the voting system itself,” Fann added.
State Sen. Warren Petersen, a Republican, confirmed that the Senate will go through with a “forensic audit” of Maricopa’s Nov. 3 election results. Maricopa County, which includes Phoenix, saw more than 2.1 million people vote during the last election.
But Bill Gates, the vice-chairman of the Maricopa Board of Supervisors, wrote Friday that the county has “nothing to hide,” adding that officials have “conducted three fully transparent audits, including two forensic audits by independent, qualified and outside Vote System Testing Laboratories.”
“I trust the Senate will be completely transparent with the public as Maricopa County has been,” he added. “From the beginning, the County sought clarification from the court. The court has ruled. I look forward to working with the Senate to provide them the information they are requesting.”
The subpoenas were issued following allegations of voter fraud and irregularities made by former President Donald Trump and surrogates including Rudy Giuliani.
A dispute over the election began when former Senate Judiciary Chairman Eddie Farnsworth held a hearing to question county officials about the election. Farnsworth and Fann then issued several subpoenas, which prompted Maricopa County to issue a lawsuit. The subpoenas were re-issued in January.
It’s not clear if the Maricopa Board of Supervisors will appeal Thomason’s decision. The Epoch Times has reached out to the county for comment.

The emails shed light on the influence a New York Democrat operative held over ballot counting in Green Bay, Wisconsin.
GREEN BAY, March 11, 2021 (LifeSiteNews) — While the national press has declared the improprieties of the 2020 presidential election a closed story, conservatives across the country still want to know just how much fraud took place, leading to the discovery of emails shedding light on the influence a New York Democrat operative held over ballot counting in Green Bay, Wisconsin.
This week, the Empower Wisconsin Foundation’s publication Wisconsin Spotlight published a report detailing the revelations contained in hundreds of pages of emails and documents detailing the disbursement of hundreds of millions of dollars in grant money from the Center for Tech and Civic Life (CTCL), a group funded by Facebook CEO Mark Zuckerberg ostensibly to “protect American elections” and “bolster democracy during the pandemic.”
In Green Bay, $1.6 million of that money led to Michael Spitzer-Rubenstein of the National Vote at Home Institute being made a “grant mentor,” functioning as what the Spotlight calls “the de facto city elections chief,” including “access to boxes of absentee ballots before the election,” despite his past work for several Democrat candidates, including “fiercely liberal” former New York City Council Speaker Melissa Mark-Viverito.
According to the emails, Spitzer-Rubenstein sought and eventually obtained a role to “help” cure (fix errors or omissions on) absentee ballots, and was even given keys to the locked room where absentee ballots were stored “several days before the election.”
Green Bay city clerk Kris Teske originally declined the request, but was overridden by pressure from the office of Democrat Mayor Eric Genrich, and ultimately resigned in October.
“As you know I am very frustrated, along with the Clerk’s Office,” she wrote to Green Bay Finance Director Diana Ellenbecker in August. “I don’t know what to do anymore. I am trying to explain the process but it isn’t heard. I don’t feel I can talk to the Mayor after the last meeting you, me, Celestine, and the Mayor had even though the door is supposedly open. I don’t understand how people who don’t have knowledge of the process can tell us how to manage the election.”
“Wisconsin election law clearly spells out that municipal clerks are in charge of administering elections,” the Spotlight’s MD Kittle writes. Wisconsin Voters Alliance and Thomas More Society attorney Erick Kaardal “said CTCL’s election security funding came with conditions that bound the city to give these left-leaning actors power they could not legally take. The mayor and his team, as well as the city council, had no legal right to limit the clerk’s role in the elections, or take them over.”
The emails also show left-wing activists devising ways to weaken election observation further still under the guise of COVID-19 social distancing. “At one point, a city official, after talking with a representative from the National Vote at Home Institute, was ‘brainstorming’ about how the city could livestream Central Count at city hall ‘so that (election observers) do not enter the building,’” Kittle adds.
The emails also reveal that city officials also wanted to hire convicted felons as poll workers, a proposal Teske also resisted. “I have made know [sic] over and over we should not be hiring felons. This is on HR. This blew up in my face a few years back,” she wrote to Green Bay finance director Diane Ellenbecker.
The state Assembly Campaign and Elections committee held a hearing on the revelations Wednesday, during which former Brown County Clerk Sandy Juno testified that she “felt it put a taint on the integrity of the election. And I come to find out later [Spitzer-Rubenstein] had all four keys and access to the ballots days prior to the election. How can we be bringing in people from outside organizations to be working on our elections with third-party money? That really doesn’t meet the smell test.”
“Andrew Kloster, who served as an elections observer in Green Bay for the Republican Party of Wisconsin, wrote in a sworn affidavit that Spitzer-Rubenstein was ordering around poll workers, handling absentee ballots and basically making life miserable for election observers,” Kittle adds. “Rivera-Wagner was the muscle behind the operation, bullying anyone who challenged his and Spitzer-Rubenstein’s authority.”
Questions about the integrity of the 2020 election were quickly branded beyond the pale by Democrats and their allies in the mainstream media and Big Tech, citing the fact that the Trump campaign’s legal challenges consistently failed in court, despite the fact that many were dismissed over process issues without ever considering the cases on the merits.
In Wisconsin, however, Republican state Rep. Janel Brandtjen, chair of the Campaign and Elections committee, promises that the latest revelations are just the “beginning of the Green Bay investigation. It’s clear that more hearings are needed to address the third party investments in Wisconsin elections. We plan to hear from all involved parties.”

SIDNEY POWELL'S DEFENSE DOMINATES DOMINION

The supreme “Art of War” is to subdue your enemy without fighting; it means having the ability to set an inescapable trap – enabling the ability to annihilate the enemy. In fictional novels, the process can be analogized to a successfully foreshadowed climax. Some only see the strategy set up in hindsight.
In chess, champions yell “checkmate.”
Once a fledgling nation-state, Genghis Khan and the Mongols led brutal campaigns under such a strategy. The Mongols used this Art while amassing the Earth’s largest contiguous empire ever. To their enemies, the most successful tactics seemed bizarre and arcane.
Thinking the moves were motivated by Mongol weakness, generals would retaliate in knee-jerk fashion. But, many powerful nations were led like sheep to the slaughter. Entire civilizations succumbed to slavery and savagery. The tactics employed were neither arcane nor bizarre. It was the Supreme Art of War, published almost a millennium before Khan devastated even the Europeans. It is widely still read today.
Dominion Voting Systems, the software company at the heart of many of the 2020 Election controversies and conspiracies, has brought several defamation lawsuits as of late. The company is seeking damages many would consider astronomical. Sidney Powell, a star former-federal prosecutor, General Flynn’s successful criminal defense attorney, and author of Licensed to Lie, is just one defendant in the crosshairs.
The lawsuit against Powell was brought in Washington, D.C., a politically questionable and legally improper place for a Colorado company to sue a Texan. The burn of political interference in the D.C. circuit is something Sidney Powell is especially experienced with. As per Dominion, Ms. Powell is alleged to have made “wild accusations” and “outlandish claims” about the company – claims that could only be verified using data from Dominion via a pre-trial discovery process and argued in court.
Powell’s legal arguments are sound. A proper trial may shed a sufficient amount of light to put to bed questions surrounding the election. Her strategy seems, in hindsight, supreme.
Despite the immediate outcry and disingenuous legacy media reporting, her recent motion to dismiss or change venue could affirm decisive legal protection for private citizens against entities that have been considered or labeled “public figures” under N.Y. Times Co. These entities are different from government officials, such as politicians, with the latter not having to guarantee the truth of their factual assertions. Politicians are practically unable to defend against defamation. If they could, some media would be bankrupt after the last four years. Now, thankfully, when public figures engage in the deprivation of constitutionally protected rights of private citizens, Americans can reap monetary damages.
Ms. Powell’s motion argues Dominion is, at minimum, a “limited-purpose public figure.” These types of “public figures” are found in cases where the defamatory statements involve a “matter of public concern” and whether the level of the plaintiff’s “participation invites scrutiny.”(Refer to Zueger v. Goss.) Ms. Powell’s statements involve the single most important election in our country – the Presidential election. And Dominion states that it operates “nearly 300” state and local elections, managing equipment that services over “40% of U.S. voters” (almost 62 million). Such standards appear satisfied.
Limited purpose public figures can defend against defaming statements but must prove the statement was made with actual malice, can be proved “true or false,” and that people accepted the statements as fact, in light of the phrasing, context, and circumstances. Statements of fact and opinions based on statistical analysis are not the same.
Dominion is claiming that Ms. Powell’s statements cannot be regarded by a reasonable person as truthful. This seems to me to be a counterproductive claim to Dominion’s cause, as it holds such answers in its software’s data—or should. All companies keep records.
What Does Dominion Have to Prove? Dominion must prove that Ms. Powell’s statements were motivated by actual malice, proven by clear and convincing evidence. This is a higher bar to vault than the typical civil standard; by a preponderance of the evidence. That is, Dominion must show Sidney Powell knew her claims were false—and peddled them anyway.
Powell has filed voter integrity lawsuits in many different states, published a 270-page public record of the evidence used has spoken on the public record and has not walked back any claims. She sounds like someone who firmly believes in the truth of her statements.
Arguments used by Dominion in court that Ms. Powell is advancing her claims because of some lucid loyalty to the former-President are meritless — by about thousands of pages of evidence and expert testimony. Evidence used by Ms. Powell is not only backed by private experts, it is backed by the federal government and many state governments — from both sides of the aisle.
Dominion, in its legal complaint, failed to state the proper type of harm necessary for relief to be granted on defamation. In fact, Dominion’s allegations are entirely devoid of the legally proper information, statements, or evidence required to succeed on its merits. That means they are asking the federal judge to punish Ms. Powell and her companies simply because Dominion wants that outcome. This is akin to a child on a playground faking a story to punish someone they do not like, except the federal government has a lot more power than a principal. We also have constitutional rights.
Our federal judiciary has consistently found political speech regarding important federal elections protected under the First Amendment. The language used in the political arena is “often vituperative, abusive, and inexact.” (Watts v. United States) Likewise, political speech is ‘inherently prone to exaggeration and hyperbole.” (Planned Parenthood of Columbia/Willamette, Inc. v. Am. Coal. of Life Activists) Speech must be “uninhibited, robust, and wide-open.” N.Y. Times. Co. Because “speech concerning public affairs is more than self-expression; it is the essence of self-government.” (Garrison v. Louisiana) Political speech regarding these events has been rigorously defended because of the profound national implications. SCOTUS has held that political speech is “entitled the fullest possible measure of constitutional protection.” (Members of City Council of Los Angeles v. Taxpayers for Vincent) Dominion, to the outside observer, by seeking such high monetary damages, seems to be extorting silence through intimidation of the court system. This should not be tolerated.
Dominion continues to claim Ms. Powell intentionally caused them damage because of some ‘unfounded, evidence-less, and fraudulently’ motivated “ill will.” Such categorical allegations by Dominion are unsupported in the complaint they filed against Ms. Powell. The Supreme Court in Iqbal found that statements like the ones Dominion made in their complaint “do not suffice to satisfy the pleading standards” to survive a motion to dismiss.
Unfortunately, too, for Dominion, the D.C. Circuit agreed with Ms. Powell this past week in a differing opinion regarding the defamation against her. As the D.C. Circuit noted, “[o]ur court… has made clear that evidence of ill will is insufficient by itself to support a finding of actual malice.” With the mountains of evidence supplied by Ms. Powell, it is clear her claims are not the ones that may seem to contain malice.
This builds upon prior D.C. Circuit precedent. In Bauman, the court found that “when a defendant provides the facts underlying the challenged statements, ‘it is clear the challenged statements represent [her] own interpretation of those facts,’ which ‘leav[es] the reader free to draw [their] own conclusions.”
This means opinions backed by evidence cannot be found to have malice. It means that the attacks against Powell for her motion are unfounded and based upon a complete disregard and appreciation for the argument in her filing.
Dominion is, in essence, claiming the global audience addressed by Ms. Powell is incapable of looking at the evidence themselves and formulating their own opinions. Talk about a wildly outrageous statement! The only way for Dominion to succeed is to release their data to prove the evidence and other experts wrong—but even then, no defaming occurred. People debate statistics all the time in public. Sidney Powell is arguing that she formed opinions based on the data, expert testimony, and evidence she was presented with.
Dominion Voting Systems is located in the old Denver Cable Car building in downtown Denver The vices executed in this pending trial-trap are so beautiful, it is hard to write a better story. The applicable state law for Dominion’s claims against Ms. Powell and others is Colorado. Certain laws can be tried under the relevant state’s laws in federal courts between citizens from different states. Unless federal law preempts, stronger state laws are ones that can apply. In this case, because Colorado is making the claims, Colorado’s law applies, even in Texas. Colorado’s Supreme Court and Constitution have stronger and more vibrant First Amendment protections and case precedents than even the United States Constitution and Supreme Court. The forum, which is crucial in jury selection for trials, is in freedom-loving Texas.
Checkmate.

PHOENIX (AP) — Republicans who control the Arizona Senate announced Thursday they now intend to do a complete recount of 2.1 million ballots in the state’s most populous county to ensure that President Joe Biden's November win was legitimate.
Senate President Karen Fann had been pushing for a “full forensic audit” of Maricopa County's election result and won a court order on Feb. 26 granting the Senate access to the ballots and tabulation machines. But she had never acknowledged until this week that she wanted a full recount, something state law doesn't allow except in narrow circumstances.
Previous documents obtained by The Associated Press showed Fann intended to recount “at least” 550,000 ballots.
The county Board of Supervisors had argued the ballots were secret and the machines need to remain secure and fought a subpoena issued by Senate Republicans.
Since winning that court fight, Fann has been trying to locate an auditing firm that can do the deep dive she wants. Some Republican backers of former President Donald Trump allege there was fraud in the election in Arizona and other battleground states that led to his defeat. Fann said she wants to answer their questions one way or the other.
Fann announced Thursday that she had decided on a specific firm to oversee the audit but did not reveal its name, saying she was still negotiating final details.
She had previously been considering a company with deep ties to Trump's campaign but said last month that it was no longer being considered. The Allied Security Operations Group worked with Trump attorney Rudy Giuliani to raise baseless allegations of election fraud and counting errors in Arizona and other states.
Fann's announcement said she now intends to do a full hand recount of the ballots in addition to testing the tabulation machines and rescanning all the ballots. She said she hopes to do the work at county buildings to ensure ballot security.
But county spokesman Fields Moseley said the county hasn't had any recent discussions about allowing the Senate to use its facilities for its new audit. Early this month. Board Chair Jack Sellers sent a letter to Fann and other GOP senators asking where she wanted the ballots delivered. The Senate said it had no room for them and hoped to use county facilities.
A full hand-recount will be challenging because it will require scores of people and observers if Fann is to end up with a trusted product.
She said she hopes the effort is bipartisan, but Senate Democrats said that is laughable.
“We never wanted anything to do with that,” said Sen. Lupe Contreras, the assistant minority leader. “I guess you could say we worked in a bipartisan way, since we backed the Board of Supervisors, which is all Republican but one,” Contreras said.
The five-member county Board of Supervisors has pointed to repeated checks that showed the election was free, fair and properly conducted. They included pre- and post-election tests of counting equipment and software and a hand count of a ballot sample that showed the machine count was accurate.
Last month, they released the results of two new audits of their equipment done to mollify the Senate. They showed no malicious software or incorrect counting equipment and that none of the computers or equipment were connected to the internet.
“When all the work is done, there will be a full report for the Senate and County to review,” Fann said in a statement. “Our voters expect this audit, and it can be a big step in returning trust and confidence in our election process.”

But she had never acknowledged until this week that she wanted a full recount, something state law doesn't allow except in narrow circumstances.Previous documents obtained by The Associated Press showed Fann intended to recount “at least” 550,000 ballots. The county Board of Supervisors had argued the ballots were secret and the machines need to remain secure and fought a subpoena issued by Senate Republicans. Since winning that court fight, Fann has been trying to locate an auditing firm that can do the deep dive she wants. Some Republican backers of former President Donald Trump allege there was fraud in the election in Arizona and other battleground states that led to his defeat. Fann said she wants to answer their questions one way or the other. Fann announced Thursday that she had decided on a specific firm to oversee the audit but did not reveal its name, saying she was still negotiating final details. She had previously been considering a company with deep ties to Trump's campaign but said last month that it was no longer being considered. The Allied Security Operations Group worked with Trump attorney Rudy Giuliani to raise baseless allegations of election fraud and counting errors in Arizona and other states. Fann's announcement said she now intends to do a full hand recount of the ballots in addition to testing the tabulation machines and rescanning all the ballots. She said she hopes to do the work at county buildings to ensure ballot security.But county spokesman Fields Moseley said the county hasn't had any recent discussions about allowing the Senate to use its facilities for its new audit. Early this month. Board Chair Jack Sellers sent a letter to Fann and other GOP senators asking where she wanted the ballots delivered. The Senate said it had no room for them and hoped to use county facilities. A full hand-recount will be challenging because it will require scores of people and observers if Fann is to end up with a trusted product.
She said she hopes the effort is bipartisan, but Senate Democrats said that is laughable. “We never wanted anything to do with that,” said Sen. Lupe Contreras, the assistant minority leader. “I guess you could say we worked in a bipartisan way, since we backed the Board of Supervisors, which is all Republican but one,” Contreras said. The five-member county Board of Supervisors has pointed to repeated checks that showed the election was free, fair and properly conducted. They included pre- and post-election tests of counting equipment and software and a hand count of a ballot sample that showed the machine count was accurate. Last month, they released the results of two new audits of their equipment done to mollify the Senate. The national Democratic machine is in panic mode over the upcoming Arizona Senate’s Maricopa County ballot audit.
Last week the Democrats sent in its national fixer, attorney Marc Elias’s firm Perkins Coie to throw around threats and make the audit go away. Today Elias took to the media in his effort to bad-mouth the audit.
The stakes are astronomical for the Dems, after all, the November 3, 2020 election steal gained them the presidency and control of Congress.
The swing states in which the 2020 election steal occurred are key to uncovering the truth and proving the fraud in the election and Arizona is one of those states.
Today Elias published a piece on the far-left “Democracy Docket” website.
"Republicans in the Arizona state senate are determined to carry on with yet another unnecessary audit of the Maricopa County 2020 election results. They’ve hired private firms to conduct the audit, including one led by a conspiracy theorist who has promoted Trump’s Big Lie and other election fraud fantasies. And now, the state senate is accepting outside donations to fund the audit—mere days after Gov. Doug Ducey (R) signed new legislation banning private donations to county administrators to help support timely, safe and secure elections, a move Secretary of State Katie Hobbs (D) said was “to satisfy the conspiracy theorists within his own party.”
Elias goes on to claim it is unfair that the Senate is soliciting funds to help pay for the audit, but neglects to mention the audit is costing more money because the corrupt Maricopa County Board of Supervisors won’t allow the Senate to perform their audit in the facility where the ballots are housed. Elias also doesn’t mention that the Board of Supervisors wasted tens of thousands of dollars on two garbage audits that provided no value other than to provide the Supervisors the clean bill of health they wished for.
Clearly from the start, Elias and the Democrats and their friends are trying desperately to hide something.
The Senate will be conducting an audit of the 2020 Maricopa County elections because the Maricopa Board of Supervisors utterly refused in its responsibilities in delivering a transparent, honest, and accurate audit for Maricopa County citizens.
The Senate has hired four teams to conduct the audit, led by Cyber Ninjas. According to AZCentral,
“The Senate said the scope of work includes scanning all of the ballots, a full manual recount of the 2.1 million ballots cast in the election, auditing the registration and votes cast as well as the vote counts and the electronic voting system.“
At the bottom of Marc Elias’s Democracy Docket alert, he sends his loyal base to an April 12 Tuscon.com article by a progressive-leaning reporter, Howard Fischer of Capitol Media Services, the guy who has had a monopoly on progressive media output in this part of AZ for decades.
With the honorary title of the “dean of the Capitol press corps” in Arizona, Fischer has been reporting since 1982, and “At last count, [he] has 24 separate publications, dailies and weeklies, plus provide audio to KJZZ.”
Fischer also regularly provides content to NPR radio stations in Arizona, whose content is the furthest left of any media source in the United States today, according to data from the respected investigative reporter Sharyl Attkisson.
This demonstrates a smooth, seamless connection between attorney Marc Elias and his Democracy Docket and Four Pillars lawfare operation and its related, Democrat-progressive-co-opted nonprofit empire and Howard Fischer, the far-left, progressive media mouthpiece and his empire in Arizona, Capitol Media Services.
Elias controls the strings of not only a mammoth U.S. nonprofit cabal of 400+ NFPs, and a related U.S. progressive attorney network of 40,000+ attorneys, but he also has his finger on the pulse of the network of top progressive reporters which favorably cover Democrat-progressive issues in any states where Elias and/or Perkins Coie have got lawfare action going.

PayPal suspends donations to volunteer ‘Rangers’ providing armed security during Arizona audit

Agroup of volunteer law enforcement officers is helping to provide extra security during the Arizona audit. The citizen’s group, the “Arizona Rangers” is a registered 501(c)(3) nonprofit, which traces its roots back to the 1880s.
The Rangers are armed uniformed volunteer law enforcement officers, who provide additional manpower when requested by local, state, or federal authorities.
In recent days, the Rangers have helped supplement the security at the Veterans Memorial Coliseum as volunteers count by hand over two million ballots. To help cover the costs of providing four to six weeks of security, the Rangers asked for donations. But after receiving a spur of contributions, PayPal abruptly blocked the processing of donations to the Rangers, the group tweeted.
After being suspended by PayPay, a GoFundMe page was established for the Rangers. The page raised a whopping $35,000 in under 20 hours, with a goal of $50,000.
Security for the recount site remains paramount as President Trump pointed out today. Trump released a statement calling for Arizona Governor Doug Ducey to beef up security amid concerns that radical-leftists may attempt to disrupt the recount.

OAN Newsroom UPDATED 8:27 AM PT – Monday, April 26, 2021 Ballot counters are working hard in Arizona to snuff-out voting irregularities in last year’s presidential election and fight off Democrat attempts to derail them.
On Sunday, forensic experts confirmed they are examining thousands of ballots cast in November as part of the audit in the Grand Canyon State. They are using ultra-violet lights to search for ballot watermarks and weed-out phony ballots.
Additionally, auditors have been split into several groups with some examining mail-in ballots and others inspecting ballot folders, envelopes along with other related items. Officials said evidence of systemic fraud has already started to show.
Democrat Party officials have tried to challenge the audit in court and they are deploying their operatives in the mainstream media in an attempt downplay the severity of election fraud as well as discredit Republican challenges to election security.
Arizona Republicans were able to continue the audit after thwarting Democrat attempts to derail the audit this weekend. On Friday, Democrats filed a temporary restraining order to stop auditors from counting the ballots. They later retreated from their position after a judge ordered them to pay $1 million if they lost their legal challenge.
The chair of the Arizona GOP, Dr. Kelly Ward, commented on the victory and gave insight into what’s to come. She said the state’s Supreme Court is set to make a decision to prevent Democrat attempts to stop the audit. The Arizona justices believe an audit is a constitutional right that protects election integrity and ensures the separation of powers.
Ward is now asking all Americans to keep watching the audit in real-time and reach out to support this effort to save U.S. elections.
Meanwhile, Trump-era trade advisor Peter Navarro has been looking ahead to a similar audit in Georgia. He predicts an audit would likely reveal election fraud in the 2020 election just as it is in Arizona. Navarro added, the scale of voter fraud in Georgia is “much larger than in Arizona” and cited preliminary estimates.
The former Trump administration advisor believes election officials let fraud slide through due to collusion between Georgia officials and Democrat Party operatives. He stressed these audit will reveal patterns of systemic fraud that were used by Democrats in battleground states last year.

FUTURE OF MARICOPA COUNTY AUDIT IN DOUBT
A judge cast doubt on the future of a Republican-backed 2020 election audit in Maricopa County that Democrats are trying to shut down through a legal challenge raising concerns about adherence to state election laws and regulations.
Maricopa County Superior Court Judge Daniel Martin, who was assigned to the case on Monday after the first judge recused himself, said that he has some reservations about the review process but needs to hear more during a hearing set for Wednesday.
“I will share with you all, I am not yet persuaded that there has been a showing that the rights of the voters in Maricopa County are being projected,” Martin said during a lengthy hearing on Tuesday. “And I think we will touch on this tomorrow when we address the policies and procedures and whether or not they can be withheld from public view."
The Arizona Democratic Party and Maricopa County Supervisor Steve Gallardo, the sole Democrat on the board, sued last week to stop the GOP-led Arizona Senate's audit, which is being led by Cyber Ninjas, a Florida-based consulting firm, and will include 2.1 million ballots cast, a forensic audit of the voting machines, and follow-up interviews with voters.
RACHEL MADDOW WARNS OF 'DANGEROUS' 2020 ELECTION AUDIT IN ARIZONA
Attorneys for the Senate and Cyber Ninjas, whose CEO, Doug Logan, has been subject to scrutiny over his promotion of voter fraud allegations and "Stop the Steal" posts on social media, argue that state election regulations don't apply to the Legislature and the audit and are asking the court to keep the audit's methods under seal as trade secrets.
But Martin appeared to disagree with the immunity argument.
“The manner in which that audit is being conducted must be balanced against the constitutional rights of the voters in Maricopa County, including the rights to secrecy and confidentiality of information,” he said.
The judge who recused himself, Christopher Coury, ordered a temporary halt on Friday of the audit that was supposed to span over the weekend, but the Democrats refused to pay a $1 million bond, and so far, the review has been able to proceed as planned.
The state Senate has possession of Veterans Memorial Coliseum only through May 14, and Alexander Kolodin, an attorney who represents Cyber Ninjas, told the judge that an injunction against the proceedings “may derail this audit," according to the Arizona Capitol Times.
But people involved in the audit stressed to reporters on Tuesday that they believe the audit will be completed by that time.
Former President Donald Trump has fixated on the audit, releasing multiple tweemails, and on Tuesday insisted it will show Arizona was a "scam election" state.
The audit will not change the results of the presidential election, as officials in the state have already certified President Joe Biden's victory, but Arizona Senate President Karen Fann insisted in a radio interview that the audit is meant to restore trust in the system and influence potential changes to the law.
"When you've got half of the people that do not trust the electoral system anymore, rightly or wrongly so, if they have questions, who is responsible for answering these questions? How do we put election integrity back into our system? And that's only what this has been about," she said.

BY ZACHARY STIEBER April 28, 2021 Updated: April 28, 2021 An Arizona judge on April 28 rejected an attempt by the Arizona Democratic Party to immediately halt an audit of the 2020 election in the state’s largest county.
Maricopa County Superior Court Judge Daniel Martin said Democrats didn’t provide “substantive evidence of any breaches or threatened breaches of voter privacy.”
The lawsuit, filed just before the audit started last week, may ultimately succeed, the judge added. But it fell short of the “strong likelihood” of succeeding standard required for a temporary restraining order.
Martin also expressed doubt that the balance of hardship in the case or public policy favors the plaintiffs—two factors that are needed to grant the order.
Arizona Democrats must now decide whether to seek a review of the ruling from a higher court or to advance to an evidentiary hearing to try to make their case for an injunction.
Lawyers for the party had argued that Cyber Ninjas, one of four firms hired by the Arizona Senate to conduct the audit, didn’t properly train their personnel and hadn’t implemented plans for security procedures, such as securing ballots.
But the exhibits they entered, including local news reports alleging lax security at the Arizona Veterans Memorial Coliseum in Phoenix, where the audit is taking place, didn’t contain enough evidence to convince the judge to halt the process.
Martin said he took into account how the audit has already started and that halting it would cause a “significant disruption.”
Earlier in the proceeding, the judge ruled against Cyber Ninjas’ attempt to file under seal documents the company described as sensitive. The company failed to show an overriding interest exists that supports filing under seal and overcomes the right of public access to the information, he ruled.
The hearing took place one day after Martin, who took over the case after the previous judge recused himself, decided against halting the audit. But he also said he could stop it during the next hearing, stoking further interest in the April 28 proceedings.
Former Republican Secretary of State Ken Bennett, tapped by the state Senate to be the audit liaison, told reporters that the facility is under armed guard 24 hours a day, seven days a week.
Only he and one other person have keys to unlock the containers the ballots are being held in when they’re not being counted, he added.
“We have to do everything we can to protect the sanctity of the ballot box. We’re never going to get 100 percent of the people to agree on who should win the election, but we should have as close as possible to 100 percent of the people who have confidence that the election process was done with integrity, and that’s what we’re here to do,” Bennett said during an April 27 press conference.
Critics including Arizona Secretary of State Katie Hobbs have called the audit unnecessary, pointing to reviews done after the 2020 election that uncovered little fraud.
“It’s clear now that there’s really nothing valid that’s going to come out of this exercise,” Hobbs, a Democrat, said during an appearance on MSNBC’s “Rachel Maddow Show” on April 27.
“All this is going to do is continue to undermine voters’ confidence in the process.”
Arizona Republican Party Chair Kelli Ward, appearing on Newsmax around the same time, accused Democrats of trying to delay the audit.
“They’re trying to throw as many problems into the process that they can to slow this down,” she said.
John Brakey, co-founder of Audit USA and a progressive Democrat, was appointed by Bennett as assistant liaison to try to stem some criticism from the left of the audit. Brakey told reporters that the 2020 election was not audited before.
Even the hand-count audit of the primary election only reviewed 1 percent, or 25 ballot batches, Brakey noted, in contrast to the full review currently going on.
That count took roughly 100 people appointed by county party chairs about a day and a half, a county spokeswoman told The Epoch Times via email.
Workers in the current audit have counted about 100,000 ballots as of April 27, according to Bennett.

Looks like the Democrats are really going crazy, trying to stop this audit. NOW they're asking the Federal government to get involved in A STATE-APPROVED VERIFICATION AUDIT OF THAT STATE'S OWN ELECTION!

LAWFARE GROUPS ASK FOR FEDERAL INTERVENTION IN ARIZONA BALLOT AUDIT - SEND LETTER TO DOJ ASKING FOR IMMEDIATE INVOLVEMENT

After the Democrat Secretary of State failed to get the Arizona State Attorney General to initiate an investigation of the audit; and after a Democrat state judge rejected the Democrat effort for a temporary restraining order; and after all other efforts have failed…. now we see three outside left-wing election groups (claiming bipartisanship yet led by lawyers from NYU) asking the DOJ to intervene in the Maricopa County, Arizona, ballot audit.
The audit started on April 23. A judge on April 28 rejected the attempt by Democrats to halt the process.
The Brennan Center, Protect Democracy and The Leadership Conference have signed a letter to the civil rights division of the DOJ asking them to get involved.
The arguments within the letter [pdf here] are identical to the arguments made previously by other Lawfare groups, including Perkins Coie, to a state judge. The state judge rejected the arguments because there was no evidence submitted to the court to back them up.
Obviously there is a great amount of fear amid the network of Lawfare and leftist activists about this ongoing ballot audit. The letter only highlights the worry they carry that Arizona’s election fraud might be demonstrably proven to the wider U.S. electorate.
WASHINGTON DC – A group of election security and administration experts are asking the Justice Department to send federal monitors to Arizona as the Republican-led state Senate carries out an audit of 2.1 million ballots cast in Maricopa County in the state’s 2020 presidential election.
In a letter to the top official at the Justice Department’s voting section, five elections experts from the Brennan Center for Justice, Protect Democracy and The Leadership Conference expressed deep concerns about how the audit is being conducted, warning that it has put ballots “in danger of being stolen, defaced, or irretrievably damaged.”
“They failed to ensure the physical security of ballots by keeping doors unlocked and allowing unauthorized persons to access the ballot storage facility,” the letter reads. “They also risk compromising the integrity of the ballots themselves, using materials and technologies that will cause the ballot paper and marks to deteriorate, such as holding ballots to ultra-violet light without gloves.

^^^ It's all pretty hilarious to anyone that's paying attention. FIRST, the Democrats lie and claim that the 2020 election was the most secure in history -- with the ridiculously record-high ballot totals under dubious circumstances in MANY states.
THEN, when faced with an ACTUAL AUDIT THAT INCLUDES both REPUBLICAN AND DEMOCRAT OBSERVERS, they suddenly become TOTALLY convinced that there's skullduggery & fraud afoot!

MARICOPA COUNTY ELECTION AUDIT ON PACE TO BE DONE BY DEADLINE: OFFICIAL

The 2020 election audit taking place in Arizona’s largest county is on pace to be done by next month’s deadline, an official said on April 28.
“The count is picking up significantly every day and with the additional shifts that we’re planning to put on, and other improvements in the process, we’re on a pace to get the job done in the time we have here at the coliseum,” former Arizona Secretary of State Ken Bennett, the state Senate’s liaison for the Maricopa County audit, told reporters.
Bennett was speaking outside the Arizona Veterans Memorial Coliseum in Phoenix, where contracted workers and volunteers are reviewing 2.1 million ballots cast in the 2020 election. The audit also includes a review of 385 tabulators and other machines used last year.
Bennett wasn’t able to provide an update on how many ballots have been audited; as of April 28, the number was just shy of 100,000.
The Senate has reserved the arena for the audit until May 14.
“We’re doing things that will get us to a number of ballots per day that will allow us to be done with the counting by May 14,” Bennett, a Republican, told reporters.
The audit started on April 23. A judge on April 28 rejected an attempt by Democrats to halt the process.
Democrats assert that Cyber Ninjas and the three other firms that the state Senate hired to carry out the audit aren’t properly trained and haven’t installed proper security procedures.
Maricopa County Superior Court Judge Daniel Martin, a Democrat-appointed judge, said plaintiffs didn’t provide “substantive evidence of any breaches or threatened breaches of voter privacy.”
Lawyers for the Senate had told the judge that delaying the audit would result in slowing the state Legislature’s weighing of election reform bills, because the audit results will directly inform the legislation.
Bennett and other officials involved in the process have argued that ballots and machines are being secured well, by armed guards, and that voter privacy is being protected.
The liaison said he was “very pleased” with Martin’s ruling.
Republicans, including state Senate President Karen Fann, say the audit is meant to restore public confidence in elections, noting that polls suggest about one in two voters in the state aren’t confident in the 2020 results, which saw Democrat Joe Biden, who went on to become president, win the state over former President Donald Trump.

EVIDENCE: VOTING MACHINES HAD UNAUTHORIZED IMPLANT TO CIRCUMVENT SECURITY IN MICHIGAN
Matthew DePerno, constitutional attorney in Michigan, revealed the forensic evidence shows Dominion voting machines had an unauthorized implant installed to circumvent its own security features.
DePerno said forensic images obtained in December 2020 show machines were connected to the internet, and evidence of “even remnants of foreign connections.”
“We’re the only case in the country that’s been actually able to look at forensic images,” he told War Room, Wednesday. “Dec. 6, 2020 we went into Antrim County and collected forensic images of [Dominion’s] election management system. We’ve been studying them since that time.”
DePerno and his team say they have “proof that voting machines used in the 2020 elections can be compromised and votes easily transferred from one candidate to another.”
DePerno said they uncovered a Microsoft “implant” installed on the machines that was not authorized by the election commission, “which means the actual system itself would be decertified.”
“You can use this type of program go directly in the database and circumvent any of these terrible easy security features Dominion has and manipulate any system they have,” he said.
“We’ve shown how unsecure they are,” DePerno said.
“Dominion wants to create this narrative which is a false narrative that their system is secured,” he said.
DePerno questioned the company’s legitimacy, when their machines could be so easily compromised.
“If you are a legitimate software company…that would be used in a national election there is no way that you would ever program a system that works like this,” he said.
DePerno said “it’s a complete lie” that his case in Michigan has no traction, or evidence.
“We have plenty of traction in this case, the evidence we have is actual evidence, it’s been verified over and over again,” he said.
“We put it into the court record,” Deperno said. “It’s right there for everyone to see.”
